Consent to Telehealth

Introduction
Telehealth uses electronic communications to deliver healthcare services when you and your provider are not in the same location. It may be used for consultations, diagnosis, treatment, prescribing, follow-up care, and other healthcare purposes as permitted under applicable state laws.
By creating an account with Reboost (“Reboost”) or using or accessing the services offered through Reboost’s platform accessible at reboost.com (the “Platform”), and the related mobile applications (the “App”) operated on behalf of Reboost (the “Services”), you acknowledge that you have read and understand this Consent to Telehealth, and you voluntarily consent to receive healthcare services via telehealth as described below.
Who Provides Your Care
Reboost operates the technology platform through which you may access telehealth services, but Reboost does not provide medical services, diagnose conditions, prescribe medications, or render clinical advice or other professional healthcare services, through telehealth or otherwise. Reboost is not a healthcare provider, licensed medical professional, or medical practice, and does not employ, supervise, control, or direct any Healthcare Provider.
Healthcare services are provided by independent third party professional medical entities (“Provider Practices”) and their employed and/or contracted licensed healthcare professionals (“Healthcare Providers”). The Provider Practices and Healthcare Providers are solely responsible for clinical care and treatment decisions.
When you access care through the Platform, you establish a provider-patient relationship with the Provider Practice and Healthcare Provider – not with Reboost. Reboost is not a party to the provider-patient relationship and does not control, direct, or supervise the clinical judgment of any Healthcare Provider. All clinical decisions, including diagnosis, treatment, and prescribing, are made solely by Healthcare Providers in their professional judgment.
Risks and Limitations of Telehealth
Telehealth has inherent risks and limitations. You understand that no method of healthcare delivery is free from risk and that telehealth cannot eliminate the possibility of an adverse outcome. You acknowledge that such risks relate to the delivery of healthcare services by Provider Practices and Healthcare Providers, and not to Reboost’s operation of the technology platform. These risks include:
- Technology limitations. The information transmitted during a telehealth encounter may not be sufficient for accurate diagnosis or treatment recommendations. Quality depends on your equipment, internet connection, physical environment, and other factors outside the Healthcare Provider’s control.
- Incomplete records. Healthcare Providers may not have access to your complete medical history or records from other providers. You are responsible for providing accurate and complete health information.
- Technical failures. Hardware, software, internet outages, or other technical problems may interrupt or prevent a telehealth consultation.
- Security risks. Despite reasonable safeguards employed by Reboost and Provider Practices, electronic communications involve inherent privacy and data security risks. Your health information could be intercepted, accessed, or disclosed by unauthorized parties due to factors outside Reboost’s control.
- Need for in-person care. Some conditions require an in-person physical examination, diagnostic testing, or procedures that cannot be performed via telehealth. You may be advised by Healthcare Providers you access through the Platform to seek in-person care.
- Clinical discretion. A Healthcare Provider may determine, at any time and in their professional judgment, that your condition is not appropriate for telehealth and may recommend in-person care, emergency evaluation, or follow-up with a local provider or other specialist.
- Emerging risks. Telehealth is an evolving field. There may be risks not yet identified or fully understood.
- Delayed or incorrect diagnosis. Telehealth limitations may result in a delayed, missed, or incorrect diagnosis or treatment recommendation.
- Communication limitations. Electronic communications may be misunderstood, delayed, or unavailable at certain times.
Your Responsibilities
You agree to:
- Provide accurate information about your identity, location, medical history, symptoms, medications, and allergies to your Healthcare Provider.
- Be physically located in a U.S. state where the Services are available during consultations, and you acknowledge your Healthcare Provider will ask in which state you are physically located to ensure the appropriately licensed Healthcare Provider meets with you via telehealth.
- Notify your Healthcare Provider if symptoms worsen or you experience adverse reactions.
- Maintain access to a compatible device, internet connection, and working camera/microphone.
- Participate from a private environment and maintain the security of your account credentials.
- Follow your Healthcare Provider’s instructions and seek in-person or emergency care when recommended.
Communications and Privacy
You consent to receive electronic communications about your care (including messages, notifications, reminders, and results) from Provider Practices, Healthcare Providers and Reboost (as agent of Provider Practices and Healthcare Providers). These may contain protected health information.
When applicable, Provider Practices handle protected health information in accordance with HIPAA and their Notice of Privacy Practices. Reboost’s data practices are described in the Privacy Policy. When applicable, Reboost acts as a business associate of Provider Practices with respect to protected health information and maintains appropriate safeguards. No electronic system can guarantee absolute security.
Recording and Third Parties
Telehealth encounters will not be recorded without your knowledge and required consent. You agree not to record encounters without the consent of your Healthcare Provider. You may request that another person participate in your encounter, and Healthcare Providers may include other professionals when appropriate.
Withdrawal of Consent
Your consent is voluntary. You may withdraw consent at any time by contacting Reboost or discontinuing use of the Services. Withdrawal will not affect services previously provided. You may always seek in-person care.
Other Documents and State Requirements
Your use of the Platform is also governed by the Reboost Terms of Service located at https://www.reboost.com/terms.html and Privacy Policy located at https://www.reboost.com/privacy.html. Additional state-specific requirements may apply and will supplement this consent where required by law.
Limitation of Liability
To the fullest extent permitted by applicable law, Reboost shall not be liable for any claims, damages, losses, or injuries arising from or related to: (a) the clinical care, diagnosis, treatment, or advice provided by any Provider Practice or Healthcare Provider; (b) the acts, omissions, negligence, or malpractice of any Provider Practice or Healthcare Provider; (c) your failure to provide accurate or complete information to your Healthcare Provider; (d) your failure to follow the recommendations or instructions of your Healthcare Provider; or (e) any decision by a Healthcare Provider that telehealth is not appropriate for your condition. You acknowledge that any claims related to clinical care should be directed to the applicable Provider Practice or Healthcare Provider.
Acknowledgment
By creating an account or using the Services, you acknowledge and confirm that:
- You have read and understand this Consent to Telehealth in its entirety.
- You understand the potential benefits, risks, and limitations of telehealth as described above.
- You understand that telehealth may not be appropriate for every condition, and your Healthcare Provider may recommend or require an in-person evaluation.
- You understand that Reboost is a technology platform and does not provide medical services, employ Healthcare Providers, or exercise control over clinical decisions, and that you are accessing healthcare services that are provided by Provider Practices and Healthcare Providers through the Platform.
- You understand that telehealth is not a substitute for emergency medical care, and you will call 911 or go to the nearest emergency room in the event of a medical emergency.
- You consent to receive healthcare services via telehealth through the Provider Practices and Healthcare Providers.
- You understand and agree that Reboost is not liable for any claims arising from the clinical care provided by Provider Practices or Healthcare Providers.
- You understand your right to withdraw consent at any time.
- You have had an opportunity to ask questions about telehealth.
- You voluntarily consent to receive healthcare services via telehealth.
- You understand and acknowledge receipt of the following California notice regarding the Open Payments database: The Open Payments database is a federal tool used to search payments made by drug and device companies to physicians and teaching hospitals. It can be found at https://openpaymentsdata.cms.gov.
- You agree to fulfill your responsibilities as described above, including providing accurate identity, location, and health information.
